What the ADA Actually Requires at an Event

Most people renting accessible units have heard a number without knowing where it comes from, so here is the rule itself.

Accessibility scoping for portable sanitation sits in the 2010 ADA Standards for Accessible Design, at section 213.2. Where multiple single user portable toilet or bathing units are clustered at one location, no more than five percent of the units at each cluster are required to meet the accessibility requirements in section 603. Any unit that does comply has to be identified with the International Symbol of Accessibility.

Two details in that sentence catch people out.

The first is the word cluster. It means a group of units placed near one another, generally within sight of or next to each other. If you spread units across four separate locations at a venue, each of those groupings is its own cluster and each one needs accessible provision. Putting every accessible unit in one corner of the site does not satisfy the rule for the other three corners.

The second is the exemption. Portable units provided on construction sites for construction personnel are excluded from this scoping requirement. That surprises people, and it is worth knowing before you argue with a general contractor about it. It is also worth saying that the exemption is about construction personnel specifically, so a site with public or visitor access is a different question.

An accessible unit also has to be reachable. Placement on stable, level ground with a route clear of curbs, steps and soft ground is part of the point. A compliant trailer at the bottom of a grass slope is not accessible in any way that matters.

Placing an Accessible Unit So It Actually Works

Renting the right trailer is half of it. Where it goes decides whether it does its job.

The route to the unit is part of the requirement, not an afterthought. That means firm, level ground and an approach clear of curbs, steps, gravel, cable runs and soft turf. Temporary matting solves most of this and is worth planning for rather than improvising on the day.

Distance matters too. An accessible unit parked at the far edge of a site technically exists and practically does not. If your venue has separate areas that people do not move freely between, treat them as separate problems.

Signage is part of the standard. Units meeting the accessibility requirements have to be identified with the International Symbol of Accessibility, which also helps guests find the right unit without asking anyone.

Lighting and surface after dark are the detail most often missed at evening events, since a route that worked at four in the afternoon can be unusable at nine.
